who passed away in September of 2006 after a six month bout with cancer.               

LESA is greatly missed by all.             

 

September 2006 SREP files appeal of SREP vs. SNF in 9th Circus Court. SREP continues to claim there is no conflict between MM-1 and the mining regulations. April 2006 Judge Hogan issues final ruling in SREP vs. Siskiyou National Forest

SREP LOSES, Waldo and Barton remain moot

March 2006 Judge Hogan issues partial ruling in SREP vs. Siskiyou National Forest, which confirmed Magistrate Cooney's order of 17 October, 2005 in it's entirety. Cooney's order of the17th of October struck intervener Hobbs 2nd, 3rd, 6th, 8th, 11th,12th, 13th and 14th affirmative defenses and granted Hobbs's 1st, 2nd and 3rd counterclaims. On the 8th of November, 2005, Judge Cooney issued his findings and recommendations for the case. Therefore we await Judge Hogan's further ruling on the rest of case relating to interveners Bartons

Barton's File Objections to Judge Cooney's finding of "mootness"

"The Bartons filed these objections because neither the Forest Service nor the Magistrate Judge has accepted their positions concerning the limitations on Forest Service planning authority with respect to mining, and the Bartons and all other miners remain subject to the very real threat of continuing unlawful conduct by the Forest Service."
